The use of cookies is governed by the obligations provided for in the second paragraph of Article 22 of Law 34/2002, of July 11, on services of the information society and electronic commerce (hereinafter, LSSI), in relation to Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, General Data Protection Regulation (hereinafter, GDPR) and Organic Law 3/2018, of December 5, on Data Protection and guarantee of digital rights (hereinafter, LOPDGDD).
It will be considered that there is processing of personal data when the user is identified by a name or an email address that identifies them (for example, in the case of a registered user) or when unique identifiers are used that allow users to be distinguished from one another and individual tracking to be carried out (for example, an advertising ID or an IP address).
The above will not prevent possible storage or technical access for the sole purpose of allowing communication between the user's equipment and the network, for the provision of a service expressly requested by the recipient. As they are excluded from the scope of application of Article 22.2 of the LSSI, it would not be necessary to inform or obtain consent for their use.
On the contrary, it will be necessary to inform and obtain consent for the use of any other type of cookies, whether first or third-party, session or persistent, that do not fall outside the scope of application of Article 22.2 of the LSSI.
